Notice of Proposed Rulemaking & Public Hearing:

The Early Learning Council has extended the public comment period until May 21, 2018 for permanent administrative rules relating to licensed and regulated child care facilities.

A public hearing has been scheduled for May 15, 2018:

6:00pm (members of the public who wish to provide testimony are limited to 5 minutes per group and must sign-up for testimony by 6:15pm)

Rule Revision: Licensed Child Care & Regulated Child Care Facilities

Notice of Proposed Rulemaking:

The Early Learning Council will begin rulemaking to adopt permanent administrative rules relating to licensed and regulated child care facilities.

ORS 329A directs the Early Learning Council to adopt administrative rules relating to licensed and regulated child care facilities to ensure the health and safety of children in care.

The Notice of Proposed Rulemaking and proposed revisions to OAR Chapter 414 Divisions 180, 205, 300 and 350 are available at the Secretary of State’s online database.

The Early Learning Council will begin rulemaking to repeal rules for the Special Populations and Migrant Seasonal Farmworker Child Care programs as these programs have been transferred to the Department of Human Services.

Rule Revision: Child Care Contribution Tax Credit Rules

OAR Chapter 414, Division 700  – Child Care Contribution Tax Credit Program

The Early Learning Council will begin formal rulemaking to adopt rules governing the Child Care Contribution Tax Credit program.

In 2003, the legislature enacted the Oregon Child Care Contribution Tax Credit to improve the quality of child care programs through education awards and quality improvement grants. The Early Learning Division is authorized to issue tax credit certificates up to $500,000 in total certificates per year. By making a contribution to the program, taxpayers receive an Oregon state tax credit of 50 cents for each dollar contributed. The Child Care Contribution Tax Credit has a sunset date of January 1, 2022.

Legislation passed in 2015 limited the amount that can be claimed against a taxpayer’s liability to 50 percent. Prior to passage of HB 2171 in 2015, the amount was set by the Early Learning Council by rule. During the 2017 legislative session, the Oregon Legislature amended the Child Care Contribution Tax Credit. HB 3066 (2017) provided technical fixes to the statutes governing administration of the tax credit. The bill removed erroneous statutory language and added language to support strategies identified following enactment of the tax credit program 2003. Rule revisions to be considered will align existing rule with these statutory changes.

Early Learning Council Hosts Community Forum in Tillamook

The Early Learning Council will be hosting a Community Forum.

What is it?
The Oregon Early Learning Council is holding a forum to hear community input on issues of equity, access, and the availability of early learning services.

Who should attend?
Families, Child Care and Early Learning Providers, Early Service Providers, community-based organizations, and other
community members. All are welcome!

Will child care be provided?
Yes. If you would like to sign-up for free child care during the forum, indicate that in the registration form.
